Ask the Expert: Duty to Accommodate and Disability Insurance (2018)

In the webinar on accommodations and legal rights for employees with Parkinson's, Eleni Kassaris, lawyer and Partner at the law firm, Blake, Cassels & Graydon LLP, stressed the importance of understanding legal rights, obligations, and the duty to accommodate. She encouraged self-advocacy while maintaining flexibility with employers and highlighted the value of seeking legal advice for workplace challenges.

The presentation emphasized the significance of individuals with disabilities understanding their legal options and benefits. Seeking pro bono legal advice from organizations like Access Pro Bono was recommended. Crucial considerations included understanding disability insurance plans, addressing affairs like wills and health representation agreements, and navigating the timing of government disability benefit applications.

Addressing human rights complaints in employment law, the webinar noted that early settlement meetings resolved over 80% of cases. If unresolved, the next step involved a tribunal hearing with potential awards for damages. Settlement options were highlighted, but litigation might be necessary in some instances, especially in unionized environments where the union could bring a grievance on behalf of the employee.
